USTR就重启对华加征关税豁免延期征求公众意见

自10月12日起,美国贸易代表办公室(USTR)就重启对某些中国产品加征301关税豁免延 期征求公众意见。
2018年,美国开始对范围广泛的中国产品加征301特别关税。作为特例,对排除清单上所列产品可以豁免。在2200项获得豁免的产品中,549项产品的豁免得以延期,但延期截止到去年年底。如今,USTR决定逐项对这549项产品进行评估,判定其是否需要恢复延期以及订立适当的延长时限。评估依据的标准有:中国是否唯一原产地;恢复豁免会否对美国的小企业、就业、生产以及关键供应链造成损害;此举对于政府设立301关税的总体目标造成的影响如何。公众评议截止到12月1日,为期50天。

CBP取消强迫劳动进口禁令

美国海关和边境保护局(CBP)近期取消了对马来西亚托普手套公司(Top Glove Corporation Bhd.)生产的一次性手套的进口禁令,该项决定于2021年9月10日起生效。

CBP曾经基于已有的相关信息,暂认定马来西亚托普手套公司的一次性手套带有强迫劳动性质,于2020年7月对该公司的相关产品发布暂扣令(WRO),并于2021年3月认定相关货物为强迫劳动产品,授权各港口启动扣留和没收货物程序。后鉴于托普公司采取补救措施,花费三千万美元补发工人工资和改善劳工生活及工作条件,CBP认为其强迫劳动迹象得以消除,满足了其关注,遂取消禁令。

【点评】
Top Glove是世界最大橡胶手套制造商。在此之前,CBP也曾做出过撤销与“强迫劳动"相关货物的暂扣令决定,如2019年,CBP对来自马来西亚的另一个手套制造商WRP的进口产品发出暂扣令,并在去年3月撤销了该命令。这一进展表明以下两点:一是被美国以“强迫劳动"名义扣留货物的外国厂商,是可以通过自身采取行动,包括与CBP直接沟通来证明自己的货物不是通过“强迫劳动"制造的,从而可能影响CBP做出的暂口令和结论;二是CBP对来自同一个国家不同公司的货物也可能采取区别对待,视个案情况决定是否撤销或维持相关暂扣令。实际上,就在本案对Top Glove做出撤销暂扣令仅一个月,CBP近日又对另一家马来西亚橡胶手套制造商Supermax生产的输美手套发出暂扣令。


欧盟将暂缓实施对中国产铝制品的反倾销措施

10月11日,欧盟决定对中国产平轧铝制品征收为期5年的最终反倾销税,税率为14.3%-24.6%。但鉴于当前欧盟同类产品市场供不应求的状况,欧盟同时决定暂缓实施9个月,延至2022年7月11日开始。依据欧盟反倾销规章第14条,在不损害内部市场的前提下可以延缓实施反倾销措施。欧洲委员会将持续监测相关市场发展状况,依据情况随时调整(提前终止暂缓措施)。

欧盟很少使用暂缓实施反倾销措施程序,据代理进口商应诉的律所分析,欧盟这次采取的暂缓实施措施是2010年以来头一次。该决定凸显了在当前特殊的市场形势下不应对关键工业产品继续征收反倾销税的必要性。



加拿大
发布复合木制品甲醛排放标准

加拿大环境部和卫生部于今年7月联合批准了《复合木制品甲醛排放法规》,对复合木制品的甲醛排放做出限定:

硬木胶合板:0.05ppm (2023年1月7日起实施);

刨花板:0.09ppm (2023年1月7日起实施);

中密度纤维板:0.11ppm(2023年1月7日起实施);

薄中密度纤维板:0.13ppm(2023年1月7日起实施);

层压制品:0.05ppm (2028年1月7日起实施)。

据专业机构分析,作为加拿大进口室内木制品的最大出口国,中国对于上述不同产品的甲醛排放规定未做分类,且在标准方面低于加方要求。

WTO强调物流服务至关重要

在10月15日举行的“数字化与物流韧性-新冠肺炎的教训与未来挑战"的线上研讨会上,WTO副总干事安娜贝尔•冈萨雷斯指出,新冠肺炎疫情再次凸显了物流是经济的命脉。目前,数字化已经成为任何物流运作和供应链管理的必要条件,物流行业面临着贸易保护主义、新的监管环境、网络安全、利益相关者系统/平台之间缺乏互操作性等诸多挑战。物流服务提供商也承受着巨大压力,以满足客户不断增长的需求。政策制定应了解数字化转型和物流行业面临的挑战。WTO正在进行的贸易谈判中涉及的许多问题,如无纸化贸易、市场准入、互操作性、数字平台等,都对物流行业的未来至关重要。

第37届UN/CEFACT论坛暨2021年欧经委成员国数字和可持续贸易便利化调查报告发布

欧洲经委会于2021年10月4日至15日举行第37届联合国贸易便利化与电子商务中心(UN/CEFACT)论坛,论坛涉及以下主题的国际标准和贸易便利化建议的制定:单一窗口评估方法、私营部门参与国家贸易便利化机构、开放金融促进贸易便利化、人工智能在贸易便利化中的应用等。数字和可持续贸易便利化调查报告涉及44个欧洲经济委员会成员国的贸易便利化情况。

《2021年亚太地区数字和可持续贸易便利化调查报告》

报告介绍了2021年亚太地区数字和可持续贸易便利化全球调查的结果,分为“一般贸易便利化"、“数字贸易便利化"、“可持续贸易便利化"、和“其他贸易便利化"四个部分。

报告显示,自2019年以来,亚太地区的经济体在简化贸易程序方面取得了持续进展,并在今年达到了历史最高点。2021 年,亚太地区31项一般和数字贸易便利化措施的实施率平均上升至 64.9%,比 2019 年高出约6个百分点。报告还强调,跨境贸易数字化具有巨大潜力,可以帮助亚太国家获得关键商品,尤其是最容易受到贸易不确定性和危机影响的国家。加快实施数字贸易计划可使平均贸易成本下降 13% 以上。亚太经合组织的 20 个经济体中约有三分之二实施了新的贸易便利化措施,以缓解供应链中断。该地区许多国家还加快实施了与透明度、机构协调、简化海关程序以及加快通关速度有关的措施。报告进一步强调了世界贸易组织《贸易便利化协定》和相关的联合国亚太地区跨境无纸贸易条约在加快疫情后经济复苏中的作用,同时强调保持贸易开放仍然是一个关键因素。随着疫情推动贸易数字化进程加快,更多工作有待开展,如利用数字技术简化海关程序和电子信息交换,并实施国家和地区文件提交和清关的单一窗口。

美国政府在规则制订中如何对待公众意见

公众意见在美国政府规则制订过程中占有重要的位置,除个别例外(不可行,无必要或损害公共利益),美国政府机构制订规则必须按照《行政程序法》征求公众意见。美国政府部门如何对待公众意见可以从三个阶段来一探究竟:

1.在新规提案公布之前:

如果政府主管机构收到公众发来的“规则制订请愿书",机构可决定将请愿公布在《联邦纪事》(the Federal Register)上,以征求公众意见;主管机构在新规提案公布之前可在《联邦纪事》上发布《关于新规提案的提前通知》,邀请公众参与新规提案的讨论,任何个人和团体均可通过提交评议来推动和改善原有的提案,也可以提出反对意见。

2.新规提案公布期间:

新规提案被发布到《联邦纪事》上,通告公众,给公众发表意见的机会。提案会设置“日期"和“地址"项,以设定公众提交评议的期限以及提交方式。必要时,征求意见期限可以延长,也可以重新征求意见或允许对公众意见发表反馈意见。对超出时限提交的意见一般不纳入考虑。评议期间,主管机构也可根据具体情况召开公开的听证会,或是举办公众大会来收集更多信息或帮助受影响的团体更好地理解新规提案。如今许多机构开始运用网络直播和互动式的线上会议来拓宽受众面。

公众评议虽然对规则制订很重要,但并非有表决效力,主管机构不会以支持规则提案的人数多寡来作为最终决定的依据,而是会将结论建立在综合考量之上,包括公众评议、科学数据、专家意见以及新规提案出台前后阶段累积的相关事实。

3.规则发布以后:

最终规则发布以后,立法程序进入合规、解读和审查阶段。当外部条件发生变化而导致规则过时,或者公众发起改变规则请愿,主管机构可发起规则审查程序,可能导致规则的修订或撤销。

个人和公司可以向法庭提起规则申诉,法庭会考量该项规则的订立是否:1)违宪;2)越权;3)遵循通告+评议的程序;4)武断、随意或滥用裁量权。如果法庭裁决一项规则的部分或全部无效,规则会被返还主管机构修正。机构可能必须重新开启评议程序,并对公众解释原因,或者从头开始制定一项新的规则。
